Using Fundry responsibly
These terms apply when you access the Fundry website, create an account or use the platform.
Effective date: 18 August 2026
Who we are and when these terms apply
Fundry is operated by Irvine David Limited, a company registered in England and Wales under company number 14824293. Our registered address is Elston Cottage, Elston Lane, Grimsargh, Preston, England, PR2 5LE.
By creating an account or using the platform, you agree to these terms. If you use Fundry for an organisation, you confirm that you have authority to bind that organisation. If you do not agree, do not use the platform.
What Fundry does
Fundry provides a structured platform through which business borrowers can prepare funding opportunities and authorised lenders can assess them, record interest and progress introductions.
Fundry may use data-led tools and artificial intelligence to organise information and prepare draft content. These tools support, but do not replace, human review and judgement.
Read how Fundry uses AIWhat Fundry does not do
Fundry does not guarantee that a borrower will receive funding, that a lender will proceed or that any opportunity is suitable. Unless we expressly agree otherwise in writing, information on Fundry is not financial, investment, legal, tax or accounting advice.
Each party must conduct its own assessment, obtain appropriate advice and decide whether to enter a funding arrangement. Any funding agreement is between the relevant borrower and lender.
Accounts and acceptable use
Keep your account secure
You must provide accurate registration information, keep it current, protect your credentials and notify us promptly of suspected unauthorised access. You are responsible for activity performed through your account unless caused by our breach.
Provide reliable information
You must have the right to submit information and documents to Fundry. You must take reasonable care to ensure they are accurate, complete, current and not misleading, and correct material errors promptly.
Use information appropriately
Information received through Fundry may be commercially sensitive. You must use it only for the relevant funding process, protect it appropriately and comply with confidentiality and data protection obligations that apply to you.
Do not misuse Fundry
You must not break the law, misrepresent your identity, infringe rights, introduce malware, scrape the service, bypass access controls, probe security, disrupt the platform or use information to send unsolicited communications.
Your content
You retain ownership of information and documents you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, copy, process, adapt and share that content only as needed to operate Fundry, provide requested features and support the relevant funding process.
You may end this licence by deleting the content or closing your account, subject to legal retention duties, existing disclosures and reasonable backup cycles.
Our content
We or our licensors own Fundry, including its software, design, branding and platform content other than user-submitted material. We grant you a limited, revocable, non-transferable right to use Fundry for its intended business purpose while your account is authorised.
You may not copy, sell, sublicense, reverse engineer or create derivative services from Fundry except where law expressly permits it.
Access, suspension and termination
Borrower registration may be self-service, while lender and administrator access is provisioned by Fundry. We may suspend or restrict access where reasonably necessary to investigate misuse, protect users, maintain security, comply with law or address a material breach.
You may ask us to close your account. Rights and obligations intended to continue after closure, including confidentiality, ownership, liability and governing-law provisions, will survive.
Availability and changes to Fundry
We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, security incidents and events outside our reasonable control may affect access.
We may update, replace or discontinue features. Where a material change adversely affects active users, we will provide reasonable notice where practicable.
Third-party services and links
Fundry may use or link to third-party services, including Companies House and technology providers. Their services and content are subject to their own terms. We are not responsible for third-party services outside our control, although we remain responsible for our obligations when a provider processes personal information for us.
Privacy
Our privacy notice explains how we collect and use personal information, including information processed by service providers and artificial intelligence features.
Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to that, Fundry is not responsible for a funding decision, the conduct or solvency of another user, or loss arising from inaccurate user-submitted information. We are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, anticipated savings, goodwill or data, to the extent permitted by law.
These terms do not affect any rights that cannot lawfully be excluded. Any separate written commercial agreement between you and Irvine David Limited will take priority if it expressly conflicts with these terms.
Changes to these terms
We may update these terms to reflect changes to Fundry, our business or the law. We will publish the revised version and update the effective date. We will give active users reasonable notice of material changes. Continued use after the change takes effect means you accept the revised terms.
Governing law
These terms and any non-contractual dispute arising from them are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where mandatory law gives you the right to bring proceedings elsewhere.
